Do You Qualify?
Florida statute Chapter 741 governs long-term child custody. The state follows a best interest of the child standard when deciding child custody matters. Grandparents, aunts, uncles and other relatives may be able to obtain long-term custody under specific circumstances. Circumstances can include:
- A child being abandoned by the parent(s)
- A parent's death
- Parental alcohol or drug issues
You must show that you have been the minor child's primary caregiver for the last, consecutive, six months or longer, and that having the child remain in your custody would be in his or her best interest.
I have helped countless relatives pursue and obtain court orders for long-term custody. Long-term custody orders enable primary caregivers to register children for school and obtain health insurance coverage for the children.
Contested Custody
As a Sarasota long-term child custody attorney, I understand that some parents may object. Typically, parents opposes long-term custody because they will lose their child support payments. When the minor child's parent(s) contest long-term custody, I can investigate the situation. My in-depth investigation can demonstrate that the child was emotionally and financially abandoned, and it is not in the child's best interest to remain in the parent(s) custody.
