Spousal Support Issues

Florida's spousal support guidelines recently changed. The court reviews several factors when deciding support, including each party's:

  • Responsibilities in the marriage
  • Income
  • Ability to earn income
  • Standard of living

There are three types of alimony. Based on your situation you may receive support or pay support under these guidelines:

  • Bridge-the-gap alimony: This is support for two years or less. The amount can be modified, but the duration cannot.
  • Durational alimony: Economic assistance to a party for set period of time for a moderate-term marriage (a marriage lasting seven to 17 years).
  • Permanent alimony: This is support for a person's lifetime. It can be modified upon showing substantial change in circumstances, upon the remarriage of the spouse receiving support or upon the spouse receiving support living in a financially dependent relationship.

Child Support Issues

Child support guidelines are based on a formula established by the state. Support is based on both parents':

  • Net income
  • Time spent with the children

Support is paid on a monthly basis, based on the needs of the child and that of a family. If you are obligated to pay support, your payment may be used to cover insurance, clothing, food and other expenses. Support is payable until a child reaches age 18; unless the child is in high school, has physical or mental handicaps, or is found dependent.

Child support modification is available under specific conditions. You must prove that you or the other parent has suffered a substantial change in circumstances.
