Stepparent Adoptions
One of my favorite things as a Sarasota stepparent adoption attorney is helping to create new families. When stepparents adopt their stepchild, he or she takes the place of the biological parent. The adoption provides the stepparent with legal obligations and rights to the child. Once the judge signs the adoption papers, you can also have a new birth certificate issued, as well as change the child's last name.
In the event of a divorce, the stepparent could sue to have time-sharing with the child and be subject to child support obligations. Additionally, the Supreme Court of Florida has made it unconstitutional to prevent gay parents from adopting.
Intrafamily Adoptions
If a biological parent is missing, dead, or has abandoned his or her child, as the minor child's relative, you may be able to pursue an intrafamily adoption. The process is much like that for stepparent adoption. In certain situations, you may litigate to have the biological parent's rights terminated.
Relatives have other options in addition to adoption. Under Chapter 741, you may be able to pursue and obtain long-term custody of a minor child.
